Fairfax Considers Relocation Request by Cannabis Business

Fairfax town officials are currently evaluating the potential relocation of the town’s oldest cannabis dispensary, the Marin Alliance for Medical Marijuana. This decision follows a petition submitted by the business owner, Lynnette Shaw, seeking modifications to the town’s zoning and permitting regulations.

Evaluating the Impact of Relocation

During a town council meeting on Wednesday, officials directed staff to provide comprehensive information on the effects of zoning and permitting changes necessary for the Marin Alliance for Medical Marijuana to relocate. The dispensary, which has been operational since 1997, is approved as a medical marijuana storefront and recreational delivery service located in a suite at 6 School St.

The findings of this evaluation are expected to be presented to the Town Council in December, where a final decision will be made regarding the relocation request.

Petition for Zoning and Permitting Modifications

Owner Lynnette Shaw submitted a petition to the council on September 24, requesting a modification to the business’s conditional use permit and the town’s zoning code to facilitate the move. Shaw cited the impending sale of the current property by the landlord as the primary reason for the relocation request. Under the existing permit, the business is required to vacate the premises by December 31, as the permit only applies to its current location.

“I’m just here to ask for cooperation in the name of compassion,” Shaw stated during the petition, emphasizing the dispensary’s longstanding presence in the community and its role in providing medical marijuana services.

Zoning Regulations and Relocation Requirements

Fairfax town has strict zoning regulations that prohibit cannabis storefronts outside of specifically designated zoning districts. To relocate the Marin Alliance for Medical Marijuana, the business must apply for new commercial cannabis business permits that designate a specific location within an approved zoning district. Additionally, the business must submit detailed site and building plans for the new location.

As of now, no alternative site has been identified, adding complexity to the relocation process. The town council will need to consider potential locations that comply with zoning laws and assess the impact of such a move on the community.

Community and Economic Considerations

The Marin Alliance for Medical Marijuana has been a fixture in Fairfax for over two decades, providing essential medical services to residents. The relocation could have various implications, including the accessibility of medical marijuana for patients and the economic impact on the current neighborhood.

Town officials are tasked with balancing the business’s needs with community standards and safety concerns. Public input and expert consultations will likely play a role in the final decision-making process.

Future Steps and Timeline

Following the presentation of the report in December, the Town Council will deliberate on the petition and the feasibility of granting the requested zoning and permitting modifications. The council will consider factors such as compliance with zoning laws, the availability of suitable relocation sites, and the overall benefits and challenges associated with the move.

Affected passengers have been given options to rebook their tickets to a later date free of charge or receive a full refund of the ticket price.

The potential relocation of the Marin Alliance for Medical Marijuana marks a significant moment for Fairfax town officials as they navigate the complexities of zoning regulations and community impact. The decision will not only affect the business and its patrons but also set a precedent for how the town manages similar requests in the future.

As the evaluation progresses, stakeholders remain hopeful that a solution can be found that respects both the business’s legacy and the town’s regulatory framework, ensuring continued access to medical marijuana for those in need.
